Florida Statute 440.205 states that no employer shall discharge, threaten to discharge, intimidate or coerce any employee by reason of such employee's valid claim for compensation or attempt to claim compensation under the Workers' Compensation Law. What does it take for an Employee to support a 440.205 claim? What can an Employer do to defend against a possible 440.205 claim? The basics of 440.205 are explained and suggestions for the Employee and the Employer are given.
