The 50 Years of Miranda
This presidential showcase will present 3 aspects of the Miranda decision. First, a detailed analysis of the decision itself, secondly a detailed analysis of the case law which followed the Miranda decision as well as what the future holds for Miranda, and lastly a glimpse into the real world aspect of how Miranda came into being. The attorney who drafted the writ of certiorari for Ernesto Miranda, Robert A. Jensen Esquire, will provide us with a rare glimpse into how his firm was selected, what his firm thought of the selection, and the background involving the writ, including its drafting and presentation to the Supreme Court. Some of these stories have never been heard before and should educate all lawyers on how the Supreme Court process works in surprising ways. In Addition, we will have insight from the attorney who argued before the U.S. Supreme Court, the case of Florida vs Powell, sometimes referred to as the second Miranda. It is our hope that this course will be educational, interesting and worth remembering.
