Hot Topics in Legal Ethics
Franklin Zemel on issues relating to providing legal representation to distressed homeowners, including issues of fee sharing, assistance with UPL, and the Foreclosure Rescue Act. Steven Teppler will address the question of: What to do with Outdated Media Storage Devices? Mr. Teppler will emphasize newly decided Ethics Opinion 10-2 and the role of confidentiality in disposing of such devices. Selected panelists will also discuss ethics rules as they specifically relate to criminal law issues.
Current Trends in Florida Bar Ethics and Lawyer Regulation: What You Need to Know
Joe Corsmeier will present a fast paced and interactive review and exploration of hot topics and current trends in lawyer ethics and regulation. Topics will include the new judicial administration rules requiring lawyers to insure the sealing of confidential documents in court files, ethical tips and traps in social networking and other electronic communication, increased sanctions imposed by the Florida Supreme Court for violations of the Bar Rules, and other current ethics topics and trends.
Conflicts of Interest: Lessons Drawn from Recent Cases
Carolyn Bell will moderate a panel including Hon. James M. Hopkins, Federal Magistrate Judge, Southern District of Florida, John W. Little, III, and Ana Maria Martinez. The panel will discuss conflicts of interest that have resulted in Bar disciplinary proceedings, disqualification of attorneys by courts, or malpractice verdicts. The panel will address recognizing clients and conflicting interests. The panel will also discuss conflict waivers.
