The Racketeer Influenced and Corrupt Organizations Act (RICO) has been called one of “the most misused statutes in the federal corpus of law." The federal criminal RICO statute, passed in 1970, was followed seven years later with its Florida counterpart. In 1986, the civil RICO provisions followed, permitting any private citizen to institute a RICO action and access the bounty of treble damages. Entranced by the remote prospect of treble damages, civil litigants continue to employ it as an “unusually potent weapon — the litigation equivalent of a thermonuclear device."
