E- Discovery in the 21st Century
The presentation will examine the Stored Communications Act (“SCA”) – a federal statute that governs the discoverability of e-mails and deleted e-mails maintained by public based internet service providers like Gmail, Yahoo and AOL – and one of the most recent court opinions construing that statute; explain how the SCA can be a barrier to discovering information residing on these accounts; and examine ways to potentially break that barrier and assist the practitioner in developing effective cloud based discovery approaches.
