Bill sets penalties for not e-filing

A Senate bill has been filed to add a “surcharge” to those who file paper copies of court or other legal documents once electronic filing is required.

Senator Mike Bennett, R-Bradenton, filed SB 410, which would require “a litigant who is required to electronically file (1) a court or other legal document in a court of this state, in the Division of Administrative Hearings, or in the Office of the Judges of Compensation Claims shall pay a surcharge in addition to any other cost incurred if the litigant files a paper document instead of electronically filing the document.”

The bill provides the surcharge would be “equal to 3.5 percent of the cost of filing the document electronically.”

The bill would not apply to litigants who are indigent.

The bill has been referred to the Senate Judiciary and Budget committees.
