Foster petitions for Bar reinstatement

Pursuant to Rule 3-7.10, Michael Sean Foster has petitioned the Supreme Court for Bar reinstatement.

Foster was suspended from the practice of law for five consecutive years for multiple cases. The consecutive suspensions began on October 8, 2009. Foster violated the following rules in Supreme Court Case No. SC08-1067: Rule 3-4.3 (Misconduct and Minor Misconduct); Rule 4-1.3 (A lawyer shall act with reasonable diligence and promptness in representing a client); Rule 4-1.4 (Communication); Rule 4-8.4(g) (Failure to respond, in writing, to any official inquiry by Bar counsel or a disciplinary agency, as defined elsewhere in these rules, when Bar counsel or the agency is conducting an investigation into the lawyer’s conduct); Rule 5-1.1 (Trust Accounts); and Rule 5-1.2 (Trust Accounting Records and Procedures); and ); in Supreme Court Case No. SC09-145 Rule 3-4.3 (Commission of any act that is unlawful or contrary to honesty and justice); Rule 4-1.3 (A lawyer shall act with reasonable diligence and promptness in representing a client); Rule 4-1.4 (Communication); Rule 4-1.5 (Fees and Costs for Legal Services); Rule 4-1.9 (Conflict of Interest; former client); Rule 4-1.16(d) (Protection of Client’s Interest); Rule 4-3.4 (Fairness to Opposing Party and Counsel); and Rule 4-8.4(g) (Failure to respond, in writing, to any official inquiry by Bar counsel or a disciplinary agency, as defined elsewhere in these rules, when Bar counsel or the agency is conducting an investigation into the lawyer’s conduct; in Supreme Court Case No. SC09-2028 Rule 4-1.3 (A lawyer shall act with reasonable diligence and promptness in representing a client); Rule 4-1.4 (Communication Rule 4-1.5 (Fees and Costs for Legal Services); Rule 4-1.9 (Conflict of interest; former client); Rule 4-1.16(d) (Protection of Client’s Interest);and Rule 4-8.4(g) (Failure to respond, in writing, to any official inquiry by Bar counsel or a disciplinary agency, as defined elsewhere in these rules, when Bar counsel or the agency is conducting an investigation into the lawyer’s conduct); Rule 4-3.4 (Fairness to opposing party and counsel).
