Update: CLE Credits for ABA Courses

This is an update to the article “Thinking of Signing Up for an ABA Course For CLE? You May Want to Think Again,“ which appeared in the February 2022 issue of Experience Matters. The article reported on the Florida Supreme Court decision In re: Rule Regulating the Florida Bar 6-10.3, which prevented CLE programs sponsored by the American Bar Association (ABA) from providing CLE credits to satisfy continuing legal education requirements in Florida. The Court concluded that the ABA’s continuing legal education policy on numeric requirements for panel diversity violated Rule 6-10.3(d) , which bans quotas based on “race, ethnicity, gender, sexual orientation, gender identity, disability, and multiculturalism” for speakers and panelists at Bar-approved CLE programs.

The ABA’s amendment of its policy to do away with the numeric requirements appears to bring the ABA’s CLE program into compliance with Rule 6-10.3(d). As a result, ABA programs may now be submitted by Florida lawyers for CLE credit. For more information, see “ABA Revises Its Diversity, Equity ad Inclusion CLE Policy” in the Florida Bar News.
