    GENERATIVE AI IN THE MODERN LAWYER’S TOOLBOX

    Used properly, generative AI can boost a lawyer’s productivity, profitability, and even “cognitive” reserves. So says Indiana University Law Professor Josh Kubicki, who addressed scores of Florida Bar members last month in Orlando for a segment of the Board Technology Committee seminar, “Legal Intelligence: Navigating the Impact of AI on the Legal Practice.” Lawyers should know that generative AI works much differently than a typical Google search, Kubicki said. “Google has trained us to put in the least amount of information possible and expect magic,” he said. “That’s not what we do with AI; it’s a conversation.” Generative AI has the power to digest the facts of a case and produce a flawless brief or legal memo, Kubicki said, but he warned that the results should always be reviewed. “Is the first page of your Google search result 100% accurate?” Kubicki asked. “Would you lift those results and put them into a legal brief? No! These tools have been known to stretch the truth.”

    LULULEMON FACES CLASS ACTION OVER ALLEGED ‘GREENWASHING’

    Lululemon Athletica Inc. faces a class action lawsuit in Miami federal court, accused of misleading consumers with its sustainability claims. Plaintiffs, represented by Joshua Eggnatz and Michael Pascucci from Eggnatz Pascucci in Davie, Florida, allege Lululemon’s “Be Planet” campaign falsely promoted environmental benefits despite increased greenhouse gas emissions. The lawsuit, before U.S. District Judge Beth Bloom, claims the campaign, launched in October 2020, led consumers to pay premiums for supposed eco-friendly products. The plaintiffs seek to hold Lululemon accountable and propose two classes: a nationwide class and a Florida subclass for purchasers since October 28, 2020.

    FIRST-TIME DUI ARRESTS TRIPLE OVER THE PAST 3 YEARS IN ST. JOHNS COUNTY

    Action News Jax has found a significant spike in DUI arrests in St. Johns County in the last three years, and records show many of them haven’t held water. Last year, there were more first-time DUI arrests in St. Johns County than any of the other counties in its judicial district. For context, Volusia County has a population almost twice the size of St Johns, and yet the home of Daytona Beach had about half as many DUI arrests last year. Getting actual drunk drivers off the street is critical, but a wrongful arrest, attorneys say, can ruin someone’s life. A spokesperson for the Sheriff’s Office says the jump reflects Sheriff Rob Hardwick’s commitment to getting drunk drivers off the street and the DUI enforcement unit he created to do that. But records show many of those arrests have been thrown out because the State Attorney’s Office couldn’t prosecute, didn’t have evidence to prove there was a crime, or the person simply wasn’t impaired.

    ‘THE FINEST TRIAL LAWYER I HAVE EVER KNOWN’: NOTED MIAMI ATTORNEY HAS DIED

    Storied Miami criminal defense attorney Neal R. Sonnett has died. The 81-year-old was celebrated as one of the finest criminal defense attorneys of his generation. Born in Brooklyn in 1942, Sonnett had been practicing law in South Florida since graduating from the University of Miami School of Law in 1967. As his career progressed, he garnered national recognition and admiration. “Neal Sonnett was quite simply the finest trial lawyer I have ever known,” said his longtime friend and former law partner Ed Shohat, who is now a partner with the Jones Walker litigation practice group. “No one—not judges, prosecutors or witnesses—could outmaneuver Neal’s intellect or quick wit in a courtroom,” Shohat said.
