Criminal Procedure Rules Committee out-of-cycle amendments to Rule 3.220 (Discovery)

The Criminal Procedure Rules Committee invites comments on the proposed rule amendments anticipated to be filed as an out-of-cycle report. The full text of the proposals can be found on The Florida Bar’s website at www.FloridaBar.org.

Rule 3.220. 27-1 Amends subdivision (d)(1)(B)(ii) to require that only reports or statements of experts that the defendant intends to use at hearing or trial be disclosed to the prosecutor; in response to a conflict created by Kidder v. State, 117 So. 3d 1166 (Fla. 3d DCA 2013), as further addressed by State v. Fernandez, 141 So. 3d 1211 (Fla. 2d DCA 2014), Manuel v. State, 162 So. 3d 1157 (Fla. 5th DCA 2015), and Thomas v. State, 191 So. 3d 500 (Fla. 4th DCA 2016).
