Proposed Amendment to Rule 1.650 (Medical Malpractice Presuit Screening Rule)

The Civil Procedure Rules Committee invites comments on the proposed rule amendments anticipated to be included in a report to the Court to comport Rule 1.650 (Medical Malpractice Presuit Screening Rule) with Section 766.106, Florida Statutes.  The full text of the proposal is below.

Interested persons have until May 1, 2020, to submit any comments, electronically, to Ardith Bronson, chair of the Civil Procedures Rules Committee, and Bar staff liaison Mikalla Davis.

Rule 1.650

 

29-0-0 In subdivision (c)(1), deletes “and” and adds “; written questions; and unsworn statements of treating health care providers” to reflect the current version of Section 766.106, Florida Statutes.

In subdivision (c)(2)(A), deletes “The parties” and adds “Any party” for greater clarity for the reader.

Adds a new subdivision (c)(2)(D) and (E) to reflect the current version of Section 766.106, Florida Statutes.
