Proposed Amendment to Criminal Procedure Rule 3.800

The Criminal Procedure Rules Committee invites comments on the proposed rule amendment anticipated to be included in a report to the Court. Interested persons have until August 31, 2020, to submit any comments, electronically, to Judge Angela Dempsey, chair of the Criminal Procedure Rules Committee, at Judge Angela Dempsey, and to the Bar staff liaison Mikalla Davis.

Rule 3.800 (Correction, Reduction, and Modification of Sentences) 34-3-0 Adds a new subdivision (d) that allows upon stipulation of the state attorney and the defendant, and notice to the victim, the court may modify or reduce sentence at any time.
