An article in the March 1 News on procedural and conduct rules proposed to implement legislation on collaborative law erroneously said that Miami attorney Ed Rubinoff, who spoke against the rules, had gone through a failed collaborative process and ended up in litigation. While Rubinoff told the court “my experience did not go well” and the process had to be “shut down” after more than $100,000 of expenditures, it did not end up in litigation. According to Regina Zelonker, who represented Rubinoff’s wife. “[I]t resulted in a signed Collaborative Marital Settlement Agreement. This agreement was incorporated into the parties’ Final Judgment of Dissolution of Marriage entered at an uncontested final hearing,” she said. Rubinoff said the agreement came after he and his attorney parted ways and he negotiated directly with Zelonker and hence he does not consider it to be a successful collaboration. He told the court the process was too long and expensive.
