Florida workgroup invites input on streamlining uncontested probate proceedings

The workgroup’s Wednesday, September 11, meeting is set for 10 a.m. to 5 p.m., virtually via Zoom. The deadline to register is August 19.

Recognizing the unique and multidisciplinary nature of estate administration, the Workgroup on Uncontested Probate Proceedings is hosting a public meeting September 11 to obtain feedback from probate practitioners and interest groups.

The Judicial Management Council’s Workgroup on Uncontested Probate Proceedings, chaired by 20th Circuit Judge Michael T. McHugh and directed by AOSC24-20, is charged with:

  • Examining the state’s practices, rules of court, and laws for uncontested probate proceedings.
  • Reviewing processes and procedures for addressing uncontested probate proceedings in other states to identify reforms that may improve the efficient and effective resolution of such proceedings in this state.
  • Making recommendations, if warranted, to improve the processes and procedures for uncontested probate proceedings and propose any revisions to practices, rules of court, or statutes that are needed to implement the workgroup’s recommendations.

The workgroup’s Wednesday, September 11, meeting is set for 10 a.m. to 5 p.m., virtually via Zoom. The deadline to register is August 19.

If you wish to speak at the meeting, select “yes” on the registration form, indicate the amount of time you request to speak, and briefly describe the substance of your comments. After registration, a confirmation email will provide the meeting link.

If you wish to submit written materials for the meeting materials packet or to present a PowerPoint during the meeting, those materials must be submitted no later than August 19. Speakers must only address strategies to improve the efficiency and effectiveness of the state’s uncontested probate processes and procedures. Comments should be succinct and a time limit will be imposed.

This meeting is not the appropriate forum to comment on individual judges, attorneys, court staff, pending court cases, or court case outcomes, according to the workgroup.

Due to time constraints, the workgroup may not be able to accommodate every speaker’s requested amount of time. The workgroup will review the description of comments provided in the registration form and any materials submitted to determine the order of speakers and the allotment of time. Speakers will be notified of their allotted time before the meeting.

The workgroup will present its findings and recommendations to the Bar’s Probate Rules Committee for comment before submitting its final report to the Judicial Management Council by July 1, 2025.
