UPL public hearing set for January 15

Pursuant to Rule 10-9.1 of the Rules Regulating The Florida Bar, the UPL Standing Committee will hold a public hearing on January 15, 2021, via Zoom, at 9 a.m., to receive testimony on whether representation in a Florida court by a nonlawyer parent/relative in an appeal from a Medicaid fair hearing Final Order constitutes the unlicensed practice of law.  To attend the public hearing, please call or email Melanie Woodall (850-561-5840; [email protected]) to request a Zoom link, which will be sent the week of the public hearing.  When requesting a Zoom link, indicate whether you intend to testify at the hearing.

A copy of the opinion request can be obtained on the bar’s website, www.floridabar.org, by clicking on Unlicensed Practice of Law, and then Formal Advisory Opinions, or by writing The Florida Bar – UPL Dept., 651 E. Jefferson St., Tallahassee, FL 32399-2300, or [email protected]. Written testimony may be filed at the hearing or prior by sending a copy to this same mailing or email address.

The hearing is the first step in the UPL formal advisory opinion process.  After the hearing, the committee will decide whether to issue a proposed opinion.  The committee has not debated or reached a decision on the question.  The committee does not have to issue a proposed opinion after the hearing.  Any proposed opinion by the committee is advisory only.
