UPL public hearing set


Pursuant to Rule 10-9.1, the UPL Standing Committee will hold a public hearing on February 7, 2020, at the Hyatt Regency Orlando Hotel, 9801 International Drive, Orlando 32819, at 9 a.m., to receive testimony on whether it constitutes the unlicensed practice of law for a Florida domiciliary employed by a New Jersey law firm (having no place of business or office in Florida), to work remotely from his Florida home solely on matters that concern federal intellectual property rights (and not Florida law) and without having or creating a public presence or profile in Florida as an attorney.

A copy of the opinion request can be obtained on the bar’s website,, by clicking on Unlicensed Practice of Law, and then Formal Advisory Opinions, or by writing The Florida Bar – UPL Dept., 651 E. Jefferson St., Tallahassee, FL 32399-2300, or emailing [email protected]. Written testimony may be filed at the hearing or prior by sending a copy to the same mailing or email address.

The hearing is the first step in the UPL formal advisory opinion process. After the hearing, the committee will decide whether to issue a proposed opinion. The committee has not debated or reached a decision on the question. The committee does not have to issue a proposed opinion after the hearing. Any proposed opinion by the committee is advisory only.
